I told the judge who presided over both of my cases in a letter that I hand delivered to the village clerk, that if he did not allow me the opportunity to present my defense he would be forcing me back into a highly abusive relationship. I told RUPCO’s COO, Sheila Kilpatrick the same. I was ignored by both of them. The judge ignored 3 orders to show cause from me. (1 from my attorney, 2 from me.) If I hadn’t been putting the rent for my apartment in escrow; if I hadn’t had the ability to pay my landlord money that he should not have gotten, that judge would have ruled in favor of me losing my home, my business, and sending me back to an abusive relationship. All in a matter of 6 months.
A judge is expected to act impartially and with integrity, ensure justice is administered fairly, and consider the human consequences of their decisions, particularly when someone’s home and livelihood are at stake. Judges are bound by rules against private discussions with one party, but this judge engaged in ex parte communication with my attorney, which is strictly prohibited unless all parties are notified. A conversation after which my attorney sat down and said, “That judge isn’t going to take your side”. When I asked him why he said, “We’re not going to get into that now.” Whatever was said during that conversation — which I still don’t know, even though I asked 3 times since court and my attorney will not tell me — influenced the outcome of my case. All of this is a serious breach of judicial ethics. The judge had multiple opportunities to address my concerns - both regarding my apartment and my store. Instead, he ignored critical information about my health and safety. Obviously a judge is not obligated to side with me, but they are obligated to ensure fair proceedings and consider the broader impact of their rulings. In my case, this responsibility was seemingly ignored entirely. The fact that this judge ruled against me in both of my cases — without allowing me the opportunity to present my defense, seemingly favoring my landlords - especially RUPCO - raises serious questions about bias and undue influence. I informed my attorney prior to court that I felt the judge held a bias against me; it was never even addressed.
The judge ignored the fact that my residential landlord was stalking and harassing me. He did not care that this was a retaliatory eviction, which is illegal. My landlord spent far more money on legal fees than it would have cost for him to just do what he said he was going to do and insulate the wall.
The judge, RUPCO, and law enforcement not only failed to take into account my mental health issues, they completely ignored them.
Losing both my home and my store within months is catastrophic. Had I not been able to pay the back rent, that’s what would have happened. A judge in a small town should understand the human and community impacts of such decisions.
Why would a judge not want to help a woman who resides and owns a small business in the town that he presides over, rather than see to it that she loses everything and ends up being abused?
There was no empathy from anyone within that court system for what I was going through or what it has done to my ability to function.
RUPCO is solely responsible for the demise of a small business and a small business owner. RUPCO has made my life a nightmare for the last 4 years. RUPCO does not stand behind its core values, two of which are “better lives” and an “improved community”. RUPCO ignored the timeline of events I shared and failed to take responsibility for its neglect and shoddy work being the cause of damages from 2 floods exceeding $120,000. The floods which I was told they would not be submitting a claim for.
They lied. About everything.
They have stonewalled me throughout this entire situation.
They did so in order to push through a 1.2 million sale to a company out the city - on Park Avenue - and evade taxes.
They committed insurance fraud with the help of their insurance company. They opened a claim without so much as a word in my name, and the insurance company denied me for 3 different reasons. RUPCO submitted fraudulent documentation about both floods and continue to lie about it. They have ignored me for 3 years.
